Varovanje osebnih podatkov

Varovanje osebnih podatkov se nanaša na način, obseg in namen obdelovanja osebnih podatkov (v nadaljevanju "podatki")  v okviru naše spletne ponudbe in z njo povezanimi spletnimi stranmi, funkcij in vsebin eksternih spletnih prisotnostih, kot npr. naš profil na družbenih omrežjih (skupno poimenovanje "spletna ponudba"). Glede na uporabljeno terminologijo kot. npr. "obdelovanje" ali "odgovorna oseba" se nanašamo na definicije v 4. členu zakona o varovanju osebnih podatkov (GDPR).

Uporabljeni termini

"Osebni podatki" so vsi podatki, ki se nanašajo na identifikacijo osebe (v nadaljevanju "podatkovni subjekt". Kot oseba, ki jo lahko identificiramo se šteje oseba, ki jo lahko identificiramo neposredno ali posredno, na podlagi imena, identifikacijske . številke, na podlagi lokacijske informacije, preko spletih indikatorjev (npr. spletnih piškotkov) ali preko posebnih značilnosti, ki so posledica fizične, psihološke, genetskih, mentalne, ekonomske, kulturne ali socialne identitete posameznika.

"Obdelovanje" pomeni vsak proces s pomočjo ali brez pomoči avtomatiziranih postopkov ali vsak postopek, ki se nanaša na osebne podatke. Termin je široko in zajema praktično vsakršno ravnanje s podatki. 

Pseudonimizacija "pomeni obdelavo osebnih podatkov tako, da osebnih podatkov ni več mogoče pripisati določenemu posamezniku, na katerega se nanašajo osebni podatki, ne da bi bili potrebni dodatni podatki, pod pogojem, da so takšne dodatne informacije ločene in da so predmet tehničnih in organizacijskih ukrepov, s katerimi se zagotovi, da osebni podatki niso dodeljeni določeni ali določljivi fizični osebi.

Profiliranje" pomeni vsako vrsto avtomatizirane obdelave osebnih podatkov, ki je sestavljena iz uporabe teh osebnih podatkov za vrednotenje določenih osebnih vidikov v zvezi s fizično osebo, zlasti vidike, ki se nanašajo na delovno uspešnost, ekonomsko stanje, zdravje, osebne preference, interese, zanesljivost, vedenje, kraj bivanja ali lokacijo te fizične osebe.

"Odgovorna oseba" je fizična ali pravna oseba, javni organ ali organ, ki sam ali v dogovoru z drugimi odloča o namenih in sredstvih obdelave osebnih podatkov.

"Procesor" je fizična ali pravna oseba, javni organ, agencijo ali drug organ, ki obdeluje osebne podatke v imenu upravljavca.

Ustrezne pravne podlage

V skladu z 13. členom GDPR, vas obveščamo o pravni podlagi naše obdelave podatkov. Če ni omenjena pravna podlaga iz deklaracije o varstvu podatkov, velja naslednje: Pravna podlaga za pridobitev soglasja je člen 6 (1) lit. a in člen 7 GDPR, pravna podlaga za obdelavo za opravljanje naših storitev in izvajanje pogodbenih ukrepov ter odgovor na poizvedbe je člen 6 (1) lit. b GDPR, pravna podlaga za obdelavo za izpolnitev naših zakonskih obveznosti je člen 6 (1) lit. c GDPR in pravna podlaga za obdelavo za zaščito naših legitimnih interesov je člen 6 (1). f GDPR. Če se zahteva obdelava osebnih podatkov, ki so za posameznika življenjskega interesa, na katerega se osebni podatki nanašajo, ali druge fizične osebe, se uporablja člen 6 (1) lit. d GDPR kot pravna podlaga.

Varnostni ukrepi

Izvajamo ustrezne tehnične ukrepe v skladu s čl. 32 GDPR, ob upoštevanju stanja tehnike, stroškov izvajanja ter narave, obsega, okoliščin in namenov obdelave ter različne verjetnost in resnosti tveganja za pravice in svoboščine fizičnih oseb ter organizacijske ukrepe za zagotovitev ravni varovanja, ki ustrezajo tveganju. Ukrepi vključujejo zlasti zagotavljanje zaupnosti, celovitosti in razpoložljivosti podatkov z nadzorovanjem fizičnega dostopa do podatkov ter njihovega dostopa, vnosa, razkritja, razpoložljivosti in ločevanja podatkov. Vzpostavili smo tudi postopke za zagotovitev uresničevanja pravic posameznika, izbrisa podatkov in ranljivosti podatkov. Poleg tega upoštevamo varovanje osebnih podatkov že pri razvoju ali izbiri strojne opreme, programske opreme in postopkov v skladu z načelom varstva podatkov s pomočjo oblikovanja tehnologij in privzetih  nastavitev zasebnosti (člen 25 GDPR).

Sodelovanje z obdelovalci podatkov in tretjimi osebami

Če v okviru naše obdelave razkrivamo podatke drugim osebam in podjetjem (pogodbenim obdelovalcem ali tretjim osebam), jih posredujemo ali drugače zagotovimo dostop do podatkov, se to izvaja le na podlagi zakonskega dovoljenja (npr. če je prenos podatkov tretjim osebam, kot to zahtevajo ponudniki plačilnih storitev v skladu s členom 6 (1) (b) GDPR za izpolnjevanje pogodbe). Uporabnik se je strinjal s  s pravno obveznostjo, ki temelji na naših legitimnih interesih (npr. uporaba agentov, gostiteljev itd.). V kolikor  pride do z našim dovoljenjem do obdelovanja podatkov s strani tretjih oseb, se podatki obdelujejo na podlagi tako imenovane pogodbe o obdelavi naročil, sin se to opravi na podlagi čl. 28 GDPR.

Posredovanje v tretje države

Če obdelujemo podatke v tretji državi (tj. izven Evropske unije (EU) ali Evropskega gospodarskega prostora (EGP) ali v okviru uporabe storitev tretjih oseb ali razkritja ali prenosa podatkov tretjim osebam, bomo le to izvedli v primeru, da pride do izpolnite naše pred pogodbene in pogodbene  obveznosti na podlagi vaše privolitve na podlagi zakonske obveznosti ali na podlagi naših zakonitih interesov. Ob upoštevanju zakonskih ali pogodbenih dovoljenj obdelujemo podatke v tretji državi le ob prisotnosti posebnih pogojev iz čl. 44 GDPR. Kar pomeni, da se obdelava podatkov izvrši na podlagi posebnih jamstev, ki so uradno priznani na ravni varovanja podatkov (npr. za ZDA preko "Privacy Shield") ali skladno z uradno priznanimi posebnimi pogodbenimi obveznostmi (tako imenovane "standardne pogodbene klavzule").

Pravice posameznikov, na katere se podatki nanašajo

V skladu s členom 15 GDPR imate pravico do potrditve, ali se podatki ustrezno obdelujejo in pravico do poizvedbe o podatkih in kopiji podatkov.

V skladu s členom 16 GDPR imate pravico do dopolnitve podatkov ali popravka napačnih podatkov, ki se nanašajo na vas. 

V skladu s členom 17 GDPR imajo pravico zahtevati, se podatki nemudoma izbrišejo, oziroma v skladu s členom 18 GDPR omejite uporabo vaših podatkov.

Imate pravico zahtevati, da se podatki, ki ste jih dali na razpolago predložijo v skladu s členim 20 GDPR in zahtevati njihovo posredovanje drugim odgovornim osebam.

V skladu s členom 77 GDPR imate pravico vložiti pritožbo pri pristojnem nadzornem organu.

Deletion of data

If users leave comments or other contributions, their IP addresses may be based on our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR be stored for 7 days. This is for our own safety, if someone leaves illegal content in comments and contributions (insults, prohibited political propaganda, etc.). Google Analytics

Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Art. 6 (1) lit. GDPR), Google Analytics uses a web analytics service provided by Google LLC ("Google"). Google uses cookies. The information generated by the cookie about the use of the online offer by the users are usually transmitted to a Google server in the USA and stored there. Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European privacy legislation (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active). Google Universal Analytics

We use Google Analytics in the design as "Universal Analytics". The content of the plugin is transmitted by Facebook directly to the device of the user and incorporated by him into the online offer. In the process, user profiles can be created from the processed data. We therefore have no influence on the amount of data that Facebook collects with the help of this plugin and therefore informs the users according to our knowledge. Shariff sharing features

We use the privacy-protected "Shariff" buttons. "Shariff" is designed to allow more privacy on the network and to replace the usual "share" buttons on social networks. In this case, not the user's browser but the server on which this online offer is located establishes a connection to the server of the respective social media platforms and asks, for example, the number of likes, etc. The user remains anonymous.
